검토보고 

1. 청원개요
가. 청원인
   서울 동대문구 청량리1동 317번지

2. 청원요지
  통일부에 6.25한국전쟁 닙북자 전담부서를 설치하여 납북자 명단 확보, 납북자 생사확인, 서신교환 및 상봉추진, 생존자 송환, 사망자의 사망일시와 장소확인, 사망자의 유해 송환 등을 요구하는 요지임.

3. 검토의견
  납북자 전담부서의 설치와 납북자 대책을 중심으로 검토하면 다음과 같음.
가. 납북자 전담부서 설치
  정부는 순수이산가족을 제외한 「6.25한국전쟁납북자」, 「국군포로」등을 특수이산가족으로 분류하고, 이를 전담할 전담부서의 설치를 부처간 협의 중에 있음.
  현재에도 납북자 가족들의 요구사항 수렴 및 대책수립 등을 위해 업부전담관 2인을 지정. 운영하고 있는 중임.
  그동안 납북자 문제는 북한이 그 존재를 부인하고 있고, 「억류되어 있는 상태」와 「자유의사의 확인」이 현실적으로 불가능하기 때문에 접근이 곤란한 사안이었음.
  또한 이산가족문제 해결, 남북교류협력의 증대 등 남북이 직면한 주요현안 때문에 납북자 문제는 공개적으로 논의되지 못하였음.
  그러나 남북정산회담으로 새로운 남북화해분위기가 조성되었고, 비전향 장기수 송환 등 제반 여건이 성숙되고 있는 실정이므로 납북자문제를 전담할 부서의 설치가 필요하다고 사료됨.

나. 납북자에 대한 대책
   납북자는 본인의 의사에 반하여 납북하였고, 그 이후에도 자신의 의사와 무관하게 북한에 억류되고 있는 자로 정의할 수 있음.
   이러한 납북자는 국군포로를 비롯하여 「6.25한국전쟁 중 납북된 민간인」,「납북어민」,「외국에서 강제 납치된 민간인」,「항공피납자」,「북송재일교포」등으로 다양함.
   납북자 문제와 관련한 정부의 그간 대응은 다음과 같음.
   먼저 정부는 1953년 발간된 「대한민국통계연감」에서 6.25한국전쟁납북자의 수를 8만 4,532명으로 발표하였음.
   1954년 스위스 제네바에서 개최된 「한국문제와 월남문제를 위한 국제회의」에서 납북자 송환을 거론하였고, 이를 계기로 국제 적십자사가 납북자 송환에 개입하게 되었음.
   이에 따라 1955년 9월 8일 한국적십자사는 국제 적십자사에 납북인사와 미송환 국군포로의 송환을 요구하였으며, 이때 제시한 납북인사의 수는 1만 7,500명이었음.
 아울러 한국적십자사는 국제적십자사에 ①납북자의 안위 및 행방 ②생존자 통보 및 생존자와 가족과의 통신 ③원거주지에의 귀환 알선 등 납북자문제 해결을 위한 3단계 방안을 제시하였음.
   또한 19546년 6월 15일부터 8월 15일까지 2개월 간 한국적십자사가 실향사민의 신청접수를 받아 파악한 납북자는 7,034명이었고, 북한적십자사측은 이중 337명의 근황만을 확인해 주었음.
   본 청원과 관련하여 정부측에서는 납북자를 「넓은 의미의 이산가족 범주에 포함」하여 해결할 방침임.
   이와 같이 납북자를 이산가족의 범주에 포함하여 해결하려는 정부의 방침은 한반도의 정치적 상황과 남북관계에 미치는 영향 등을 감안한 부득이한 조치라고 사료됨. 
  그러나 납북자는 자신의 의사에 반하여 북한에 억류되고 있는 자로서 국민의 생명과 재신을 보호해야 할 국가의 책무와 관련되는 사안이며, 북한에 억류되어 있는 납북자 자신의 생명과 인권뿐만 아니라 국내에 있는 가족들의 생활환경에도 심각한 영향을 미쳐온 문제임.
 따라서 정부측에서는 남북교류가 확대되면 남북장관급회담과 남북적십자회담 등 다양한 대화채널을 통해 납북자의 생사확인, 무사귀환 및 송환, 납북자의 현지신변 확보, 유해송환 등이 실현될 수 있도록 중장기 대책을 다각도로 강구해야 할 것으로 사료됨.

 단기적으로는 남북간 이산가족교류가 제도화·정례화될 때까지는 납북자를 광의의 이산가족에 포함하여 생사확인에 우선순위를 두는 것이 현실적인 접근방법으로 사료됨. 이와 더불어 이산가족교류시에도 납북자가족이 더욱 많이 포함되도록 하는 적극적 배려가 요망됨.

다. 종합의견

 납북자 문제는 북한이 그 존재를 부인하고 있는 현실 하에서 그 동안 매우 민감한 사안이었음.⑸

 그러나 남북정상회담, 비전향장기수 송환고 이산가족 교류 등을 토대로 남북교류가 제도화·정례화될 경우 납북자의 생사확인, 생존자의 송환과 사망자의 유해송환 등 제반대책도 남북간에 논의 되어야 할 것으로 사료됨.
 따라서 본 청원은 본 위원회 산하에 「통일소위원회」를 설치하여 동 소위원회에 회부해서 납북자 전담부서의 설치를 비롯하여 정부측의 납북자 문제 해결방안 이외에도 납북자가 송환 또는 귀환하였을 경우 국내거주 대책 등 실질적이고 구체적인 명예회복이 이루어 질 수 있는 대책 등을 중심으로 보다 심도있게 심의할 필요가 있다고 사료됨.

 한편 이 청원은 본 위원회에 계류되어 있는 「납북국회의원 생사확인등에 관한청원」(2000.12.20, 청원인:전대열, 소개의원:최병렬), 「남북이산가족교류등에관한특별법안」(2000.11.17, 장성민의원외 19인), 「납북자가족생활안정지원법안」(2000.11.29, 강삼재의원등 9인외 124인) 등과도 연계하여 종합적으로 검토할 필요성도 있는 것으로 판단됨.

`55. 9. 8 한국적십자사는 제 18차 적십자국제회의(1952)에서 가결된 결의사항 제20호(이산가족의 재회문제)을 근거로 납북인사 17,500명과 미송환포로 2,200명의 행방조사와 송환을 주선해 줄 것을 국제적십자사에 요청

- 한적은 `56. 6.15∼8.15간 실향사민 재등록을 실시한 결과 7,034명이 최종등록, 국제접십자사를 경유 북측에 실향사민 안부탐지조회서 전달(`56.10)

○ 북측은 `57. 1 북한적십자사 이병남 명의로 14,132명의 행방을 의뢰

○ `57.11 뉴델리에서의 제19차 적십자국제회의에서 북측은 7,034명중 337명에 대한 생존자 명단을 우리측에 전달

- 우리측은 14,112명이 자진 월남자라고 통보
